Ninex Developers, directors booked for cheating buyer of Rs 89 lakh

Gurugram-based Ninex developer and its directors have been booked for allegedly cheating a buyer of Rs 89 lakh.

The complainant, Reena Sethi, is a resident of Delhi’s Dwarka. She booked a flat in a residential project in Sector 76 for Rs 89 lakh in September 2016. The realtor, Ninex Developers, promised to buy the flat back after a certain period. The developer gave two cheques as payment, but they were returned by the bank without being encashed as the account had been blocked, she alleged.

A Ninex representative denied any wrongdoing. “We are seeking legal opinion in the case,” the representative said.

Reena, meanwhile, said she booked a flat of 1,952 square feet in G-Block of Ninex City. “As per the buyback scheme, the developer had given assurances of buying back the unit for Rs 1.2 crore at any time after October 2019. The developer also issued two cheques of Rs 58 lakh and Rs 60 lakh each to me,” she said.

But the project was far from completion and construction of G-Block, in which Reena had booked a flat, had not even started in October 2019. “I deposited the cheques given by the builder as I wanted to sell my flat. The bank returned them saying the account was blocked,” Reena said.

Unable to get any relief from Ninex, Reena approached Gurugram police for registration of FIR, but no case was lodged. Finally, she approached Gurugram court at the end of 2019. On the directions of the court earlier this week, an FIR was registered against the developer and its directors under sections 403 (dishonestly misappropriating any movable property), 406 (criminal breach of trust), 420 (cheating), 467 (forgery), 468 (forging document), 471 (using forged document), 120B (criminal conspiracy) and 34 (common intention) of the IPC at Sector 50 police station on Thursday.
